Family Court
In early 2019, Katie Riford went into hiding with her two children, Mason & Olivia Riford. The children’s father, Peter Diarbakerly (Boston, MA), and his family had a documented history of physical and emotional abuse toward the children. Despite ample evidence of this abuse, the Niagara County Family Court Judge Erin Delabio, refused to look at any Katie’s evidence during the court proceedings, often stating during court proceedings “she has not had a chance to review the evidence”, further enabling the conduct to continue. During the family Court proceedings, the father was allowed to have court ordered supervised visitations, with what was supposed to be a licensed clinical social worker. Katie’s family would find out through Freedom of Information Law (‘FOIL’) request that Jeanne Kratt was not a licensed clinical social worker as the Niagara County Family Court portrayed. Katie would also report Niagara County Judge Erin Delabio to the NYS Commission on Judicial Conduct. Her own attorney at the time, Anthony Cervi, would tip Judge Erin Delabio off that Katie and her family reported her to the NYS SCJC.
The Federal Bureau of Investigation – FBI Special Agent Brian Burns
Katie and her sister Christina Little Riford, would go to the FBI Field Office in Buffalo, NY to report these Federal employee’s misconduct. FBI Special Agent Brian A. Burns would be the one to talk to Katie and her sister. FBI Agent Burns was familiar with Peter M. Vito, as he said he worked on his wife’s case Elizabeth Donatello. Elizabeth was an ex-employee of Niagara County who sued for sexual harassment and ended up getting a large money settlement. Christina mentioned to Brian A. Burns that she believed FBI Burns working on Katie and her complaint on the two Federal U.S. Customs and Border Protection employees would be a conflict of interest, as it appeared he helped out Peter Vito and his wife before. FBI Burns insured Katie and Christina it would not be, but ultimately the Riford’s would find out their original assumption to be correct. Since Katie’s brother, Kevin Riford was not present at this meeting with FBI Burns, a phone call was arranged for a later date, so Kevin Riford could also report what he had seen. The phone call did occur at a later date with Kevin, Christina, and Katie Riford on the phone. FBI Special Agent Brian Burns would have U.S. Customs and Border Protection Investigator “Kelly Marshal” on the phone. Although, the Riford’s would never be able to obtain Kelly Marshals contact information, as they requested it several times from FBI Burns. The Riford’s would find out at a later date that FBI Agent Brian A. Burns, was making plans to hurt Kevin, which was picked up in the phone call. We will come back to this point later, below is the 2019 audio in which Kevin, Christina, and Katie Riford reported the U.S. Customs and Border Protection employees to FBI Brian Burns and “Kelly Marshal”.
The reason U.S. Customs & Border Protection employee “Kelly Marshal” is in quotes is because FBI Special Agent Burns would never provide her contact to the Riford’s, despite the Riford’s numerous attempts to obtain it from FBI Burns. Below is an email of Katie Riford attempting to obtain her contact info. Brian Burns would state she’s out of the office today and never received a phone call back from “Kelly Marshal”.
Katie Riford’s sister, Christina Little Riford, would also call FBI Brian Burns to question the legitimacy of Kelly Marshal. FBI Burns would say, she identified herself and showed him her badge. Audio is below.
The Riford’s would also discover at a much later date that Buffalo, NY FBI Special Agent was a ‘dirty’ Agent of the FBI. Several articles have been published regarding FBI Brian Burns conduct. Allegations include TN Action News 5 – not having informants sign the appropriate paperwork, allowing informants to smoke pot with politicians (informants aren’t not supposed to commit crimes), allowing an informant to produce parts of film in his FBI office (Burns claims he didn’t know), and also obtaining a person’s emails without a warrant – according to the attorney representing that person which was published by Buffalo, NY media Artvoice. Originally, FBI Special Agent was stationed in Tennessee, but when he was exposed by local news media, he was transferred to the Buffalo, NY Field Office, where the Riford family resides.
The Burns Family Donation to Family Court Judge Erin Delabio
The Riford’s would discover in the year 2023 that a person named Jason Burns donated $1,000 to Niagara County Family Court Judge Erin Delabio, one of the highest single amount donations in 2017. It is suspected that FBI Special Agent Brian A. Burns is related to Jason Burns, which adds another reason why FBI Agent Burns was working against the Riford family. Jason Burns and his brother Robert (Bob) Burns own every Tim Hortons in Niagara County.
U.S. Customs & Border Protection/Private Investigators
During these supervised visits, harassment would occur to Katie Riford, often after dropping off her children for the visitations. On one particular occasion, Katie and her mother Joanne were followed extremely close and tailgated. This person would run through red lights to continue to follow Kaite and her mother. Katie called her brother Kevin to see if he could be of any assistance. As Kevin would come to the scene, he would see a dark pickup truck following his sister closely and going through redlights to keep up with Katie’s vehicle. Kevin would call the police and follow the vehicle in order to facilitate a police report and hopefully learn the identity of whom was doing this.
The pickup truck who was following Katie Riford would bring her brother on a high-speed chase, going through Cheektowaga, New York through Buffalo, NY, ultimately ending at the Cheektowaga Police Station. During this encounter, another unknown pickup truck would join, which the Riford’s would later find out was friends with the other pickup truck that was originally following her. The Riford’s would learn that the two pickup trucks were two private investigators, who were employed by Peter M. Vito Associates. The Riford’s would also learn that the two private investigators were also employed as Federal U.S. Customs and Border Protection employees. These two were moonlighting as private investigators. The two U.S Customs and Border Protection Employees were Michael Mazga and Patrick Ostrowski. Not only would the Riford’s report the two PI’s for the car chase incident, but they would also report Patrick Ostrowski for his racial Facebook posts. They would find out later that U.S. Customs and Border Protection Patrick Ostrowski had a relative who was a current police officer with the Niagara County Sheriff’s Office.
Kevin’s Arrest
After exhausting all avenues, Katie Riford decided to go into hiding with her two children, Olivia and Mason. Kevin would receive a phone call from a Niagara County Sheriff’s Officer named Nick Faso. As it would turn out, the Faso family are friends with Family Court judge Erin Delabio. On this phone call, Officer Faso would ask Kevin several questions to which he did not know the answer to. Officer Faso would ask to meet with Kevin Riford to which Kevin responded let’s meet at Colton R.V, which is a business with plenty of lights and cameras. Officer Faso would respond to Kevin by stating “you’re not calling the shots”. Kevin would drive home as he received a phone call that someone was pounding loudly on the door, as it would turn out it was Officer Faso at the Riford’s residence. Upon arriving, Kevin noticed the Niagara County Sheriff car running idle in front of his family’s driveway. The car would driveaway, however, Kevin thought it would be a good idea to talk to the Officer since he was already at his house. Kevin would briefly follow the officer, and the Officer Nick Faso would make a U-turn and roll his window down. Kevin and Mr. Faso agreed to talk. However, Mr. Faso would end up arresting Kevin, for second degree harassment (a violation in NYS), stating that Kevin was following his closely. In our opinion, this was clearly in retaliation for reporting the two Federal U.S. Customs and Border Protection employees. It would turn out one of the two Federal employees named Patrick Ostrowski would have a family member who worked as a police officer for the Niagara County Sheriff’s named Todd Ostrowski. Kevin Riford would hire Depew, NY Attorney Michael Dwan who would tell Kevin “You don’t fuck with the FBI”. He would also indicate on a separate occasion that Kevin Riford would have a “target on his back”, “it’s too easy for the police to ruin his life”, and that “he doesn’t know if this follows you or not”.
A Request for Assistance from the Erie County Executive Mark Poloncarz
Christina Riford had made a package for Kevin Riford to drop off at Erie County Executive Mark Poloncarz’s Office, located at the Rath Building in Buffalo, NY. The package contained documents related to the family court corruption. Kevin would go to the Rath building, through security and had the package place through an x-ray machine. Kevin would proceed on the elevator and drop off the package to the employee at the reception desk of Mark Poloncarz Office. The employee’s name was Kelly. After dropping off the package, the building would be shut down because of a “suspicious package”, according to Mark Poloncarz. Police would also call Kevin and go to Christina’s house. Kevin and Christina lived separately. Erie County Police would accuse Christina of having involvement with the benign package but would soon back off once Christina Little stated she had audio of the package being dropped off. The Erie County Police would state to Christina “how do you know a bomb wasn’t in the package, utilizing scare tactics to elicit a reaction. The Erie County Executive Mark Poloncarz would later tell the media, nothing dangerous was in the package. A few days later, Mark Poloncarz would have a knife put in a tree outside his house. In our opinion, this was to scare Mark Poloncarz from actually investigating the documents in the package. Multiple years later, Mark Poloncarz would also be accused of threatening to shoot a process server and claims of domestic abuse. With all the negative coverage of Mark Poloncarz, you would think someone was targeting him. Below is the video with Christina and Kevin Riford talking to Buffalo, NY WGRZ Dave McKinley.
The Riford’s alarming FBI Special Agent Brian Burns audio discover & subsequent reporting to the police
Within 1-2 months after the package is dropped off at the Rath building, a startling discovery is found by the Riford family. They listened back to their conversation with FBI Special Agent Brian A. Burns and discovered that he made multiple disturbing statements while conversing with Katie, Christina, & Kevin Riford which could be heard. These statements were 1.) “let’s kill him”, 2.) “Investigate the grey car, over, it’s his sister” and 3.) “lock-pick the car”. The Riford’s played this audio for several other family members and friends, and they all agreed that those statements could be heard. Christina Little Riford and Kevin Riford would report this audio to multiple police departments including the New York State Police, Town of Tonawanda Police, and Erie County Sheriff’s Office. The Town of Tonawanda Police told the Riford’s to contact the FBI’s department of professional responsibility, which they did. The Erie County Police Detective would criticize and ridicule the Riford’s telling them that “they are cop shopping”, “why don’t you go to the military police”, “the audio was obtained illegally”, and state that the “police can’t investigate the FBI”. The NYS Police came to the Riford’s residence in response to an email Kevin Riford sent to NYS Governor Andrew Cuomo regarding the FBI Agent Burn threats. Ultimately, NYS Police Officer Bonnerb would put in the police report “he went to misplacedpower.org and the audio is no longer there”, even though the audio is still there today as of December 2024. Clearly, NYS Police Bonnerb intentionally sandbagged the case. On February 28, 2021, New York Attorney General Letitia James announced that she would hire and deputize a law firm to conduct an independent investigation into the allegations of sexual harassment by Governor Cuomo.

Subsequent Retaliation & Harassment
After reporting Special Agent FBI Brian Burns and U.S. Customs and Border Protection & Peter Vito employees Michael Mazga and Patrick Ostrowski for their conduct, the Riford’s would subsequently face harassment/retaliation. Peter M. Vito of Peter M. Vito Associates would go door to door to his family’s house and other residents in Niagara and Erie County. He would state multiple defamatory lies, perhaps the most notable lie stated by Peter Vito was that “Kevin was a member of the sovereign citizens. If you look this group up on the FBI website, they are labeled as a domestic terrorist group. Clearly, Peter Vito was retaliating for reporting FBI Burns and his employees. It should be noted that Peter M. Vito was previously employed by the Niagara County DA’s office and Erie County Police Department. He also employees past and current federal, state, county, and town employees – from town judge to police to ex-FBI, they are and have been on Peter Vito’s roster. After doing research, the Riford’s discovered that Peter M. Vito has been accused of doing bad things in the past.
While Peter M. Vito told news reporters that he was conducting surveillance from the Riford residence, what he didn’t tell them is that he was also conducting illegal warrantless surveillance utilizing cameras at neighbors’ houses. Katie Riford’s mother would wonder, how do these harassers know when we would leave our house? It wouldn’t be long until they discovered one neighbor had hidden a camera in a plant in their window. This camera directly covered their porch. The second neighbor’s camera would cover their garage/front of house. Photos of cameras are from yr. 2020.
United States House of Representative Chris Jacobs
Kevin Riford would call United States House of Representative Chris Jacobs office the FBI in 2021. He would have a lengthy conversation with his office. On 07/28/2021, United States House of Representative Chris Jacobs would email Kevin regarding the FBI.
Subsequently on February 28, 2022, Chris Jacobs would be under investigation by the Office of Congressional Ethics. On March 1, 2023, the Buffalo, NY building owned by Chris Jacobs would burn down. Oddly enough, these circumstances remind the Riford’s of what happened to Mark Poloncarz.
